These Terms of Service ("Terms") govern your use of Sagely Sprout ("the Service"), operated by Sagely Sprout ("we," "our," or "us") from Arizona, United States. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
Sagely Sprout is an AI-powered garden planning application that helps home gardeners design vegetable and flower garden layouts, track plants and harvests, and receive AI-generated gardening guidance. The Service includes a free tier (Sprout) and paid subscription tiers (Grower, Master Gardener).
3. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@sagelysprout.com if you suspect unauthorized access.
You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this requirement.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse of AI systems, or are used for commercial purposes without our written consent.
4. ⚠️ AI-Generated Content Disclaimer
THIS IS CRITICAL. PLEASE READ CAREFULLY.
The garden plans, plant recommendations, pest diagnoses, harvest recipes, growing schedules, and all other content generated by Sagely Sprout's AI features are automatically generated suggestions for informational purposes only.
- AI-generated recommendations may be inaccurate, incomplete, or inappropriate for your specific growing conditions, climate, soil, or local regulations.
- Sagely Sprout is NOT a substitute for advice from a certified Master Gardener, agricultural extension office, or local horticultural expert.
- We make no guarantees about crop yields, plant survival, pest control outcomes, or the safety of consuming anything grown using our recommendations.
- Always verify planting information against local resources, seed packet instructions, and expert guidance before acting on AI-generated advice.
- Some plants may be toxic to pets or children — always independently verify the safety of plants before introducing them to your garden.
- We are not liable for any crop losses, property damage, or personal injury resulting from following AI-generated recommendations.
5. Subscriptions and Payments
Free Tier (Sprout): The free tier includes one (1) lifetime AI garden plan generation and access to basic features as described on our pricing page. Features and limits are subject to change with reasonable notice.
Paid Tiers: Grower ($4.99/month or $44/year) unlocks additional features as described on our pricing page. Master Gardener is coming soon; its pricing will be announced before launch. Prices are in US dollars and are subject to change.
Billing: Subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have paid.
Refunds: We offer a 7-day money-back guarantee on new subscriptions. If you are not satisfied within 7 days of your first payment for a given tier, use the self-serve refund button on the Plans page for an instant full refund (or contact billing@sagelysprout.com). After 7 days, payments are non-refundable except where required by applicable law. See our full Refund Policy for details.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulations
- Attempt to reverse engineer, scrape, or extract AI models or data from the Service
- Abuse or circumvent AI usage limits (e.g., repeatedly deleting and regenerating plans to exceed the free tier)
- Use the Service to generate content that is harmful, hateful, or violates the rights of others
- Share your account credentials with others or use a single account for multiple users commercially
- Use automated scripts or bots to access the Service without our written permission
7. Intellectual Property
Our Property: The Sagely Sprout name, logo, application code, design, and AI system are owned by us and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of our Service without our written consent.
Your Content: You retain ownership of the garden data, notes, and content you create within the Service. By using the Service, you grant us a limited license to store and process your content solely to provide the Service to you.
AI Outputs: Garden plans and other AI-generated content are provided to you for your personal use. We make no claim of copyright over AI-generated outputs, but they are generated using our proprietary systems and may not be used for commercial AI training purposes.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAGELY SPROUT AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF CROPS, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU IN FULL.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in Maricopa County, Arizona, except that either party may seek injunctive relief in court for intellectual property violations.
You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we decide to discontinue the Service. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data before termination by contacting us.
